Welcome to Price of Health. These Terms of Service (“Terms”) govern your use of the Price of Health website, products, programs, services, and purchases.

Price of Health LLC (“Price of Health,” “POH,” “we,” “us,” or “our”) is a wellness company based in the Dallas–Fort Worth area. E’s Healthy Eats (“EHE”) operates as a division of Price of Health LLC.

By using this website, purchasing products or services, submitting an inquiry, or participating in services offered by Price of Health, you agree to these Terms.

Price of Health may offer products and services including personal training and fitness coaching; virtual training and workout programming; group fitness and community wellness activities; corporate and organizational wellness services; meal preparation, catering, and nutrition coaching through E’s Healthy Eats; and apparel, merchandise, and other lifestyle products.

Availability, pricing, scheduling, eligibility, and specific terms may vary by service.

Submitting an inquiry or consultation request does not guarantee availability, acceptance into a program, or a reservation.

Price of Health provides fitness, wellness, and educational services. Information provided through the website, coaching, training programs, presentations, social media, or other Price of Health materials is intended for general wellness and educational purposes.

Price of Health services are not medical care and are not a substitute for diagnosis, treatment, or advice from a physician or other qualified healthcare professional.

You are responsible for determining whether you are physically able to participate in an exercise or wellness program and for obtaining medical clearance when appropriate.

Participation in physical activity involves inherent risks. Clients and participants are expected to follow instructions, communicate relevant limitations, and stop activity if they experience pain, dizziness, unusual shortness of breath, or other concerning symptoms.

Additional waivers, informed-consent forms, or participation agreements may be required for particular programs or events.

Nutrition coaching and educational information provided through Price of Health or E’s Healthy Eats is intended to support general wellness, healthy eating habits, and practical nutrition.

Unless services are expressly provided by an appropriately licensed or credentialed healthcare professional acting within their authorized scope, nutrition information should not be interpreted as medical nutrition therapy, diagnosis, or treatment of a medical condition.

Customers with allergies, medical conditions, dietary restrictions, or other health-related nutrition concerns should consult an appropriate healthcare professional.

E’s Healthy Eats offers food services that may include meal preparation and catering.

Customers are responsible for communicating known food allergies or dietary restrictions when placing an order or arranging catering services.

While reasonable efforts may be made to accommodate dietary requests, food may be prepared in environments where common allergens are present. We cannot guarantee that any food item is completely free from allergens or cross-contact unless expressly stated otherwise.

Catering orders may be subject to separate proposals, invoices, minimum charges, deposits, final headcount deadlines, cancellation terms, and event-specific agreements.

Deposits for catering and event services are subject to a maximum 30-day refund eligibility period beginning on the date the initial deposit is paid, as well as the cancellation deadlines associated with the scheduled event date.

A cancellation made 15 or more days before the scheduled event and within 30 days of the initial deposit payment is eligible for a full refund of the deposit.

A cancellation made 8–14 days before the scheduled event and within 30 days of the initial deposit payment will result in forfeiture of 50% of the deposit, with the remaining 50% eligible for refund.

A cancellation made 7 days or less before the scheduled event will result in forfeiture of 100% of the deposit.

Once 30 days have passed from the date the initial deposit was paid, the deposit becomes non-refundable, regardless of the amount of time remaining before the scheduled event.

When the 30-day deposit deadline and an event-based cancellation deadline would produce different outcomes, the earlier applicable deadline controls.

Event-specific proposals, invoices, or written agreements may establish additional payment, headcount, cancellation, or service requirements. Where event-specific written terms differ from these general Terms, the event-specific written terms control for that event.

Each purchased training package includes one cancellation with rescheduling privileges. The client must provide at least 24 hours’ notice to use this option.

The cancelled session must be rescheduled and completed within 30 days of the cancellation date.

After the one permitted cancellation/reschedule for that purchased package has been used, an additional cancelled session is not eligible to be rescheduled by the original client. Instead, the client may gift that session to an individual who is not currently a Price of Health training client.

A gifted session must be redeemed within 30 days of the cancellation date, is subject to scheduling availability and applicable participation requirements, and has no cash value.

Each newly purchased training package includes its own one cancellation/reschedule privilege.

Product descriptions, photographs, sizes, availability, and pricing are presented as accurately as reasonably possible.

Colors and appearance may vary slightly based on lighting, photography, displays, and devices.

Products are subject to availability. We reserve the right to correct errors involving product descriptions, availability, or pricing before fulfillment.

Prices are displayed in U.S. dollars unless otherwise stated.

Payments made through the website may be processed using third-party payment services, including PayPal.

Applicable sales taxes, shipping charges, delivery charges, or other disclosed fees will be calculated or presented as part of the transaction when required.

Price of Health reserves the right to change future pricing. A pricing change will not retroactively alter a completed purchase except when necessary to correct an obvious error or as otherwise permitted by law.

Available fulfillment options may include standard shipping and local pickup.

Estimated shipping or fulfillment times are estimates rather than guaranteed delivery dates. Delays caused by carriers, weather, incorrect addresses, or circumstances outside our reasonable control may affect delivery.

Customers selecting local pickup are responsible for retrieving their orders according to the pickup instructions provided.

Eligible merchandise may be returned within 14 days of delivery or local pickup for an exchange or Price of Health shop credit. Refunds to the original form of payment are not offered for standard merchandise returns.

Returned merchandise must be unworn, unused, and have all original tags intact.

Customers are responsible for return shipping costs for exchanges or shop-credit returns unless the merchandise received was defective or incorrect due to an error by Price of Health.

Shop credit may be used toward eligible merchandise available through the Price of Health collection and has no cash value.

Food, used merchandise, customized goods, services already rendered, and other items that cannot reasonably be resold are final sale where permitted by law.

Nothing in this policy limits rights or remedies that cannot legally be waived.

Certain website features may allow customers to create accounts, while other purchases may permit guest checkout.

You are responsible for providing accurate information and, when an account is used, maintaining the confidentiality of your account credentials.

You agree not to misuse another person's account or intentionally provide false information in connection with an order or service.

The Price of Health name, E’s Healthy Eats name, logos, branding, website content, graphics, original photographs, program materials, written content, and other proprietary materials are owned by or licensed to Price of Health LLC unless otherwise indicated.

They may not be copied, reproduced, distributed, sold, or commercially exploited without permission except as allowed by applicable law.

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, submit fraudulent transactions, introduce malicious software, scrape protected information, or use the website for unlawful purposes.

The website may use or link to third-party services, including payment processors, shipping providers, mapping services, or other platforms.

Those services may operate under their own terms and privacy practices. Price of Health is not responsible for the independent operation of third-party websites or services outside our control.

To the fullest extent permitted by applicable law, Price of Health LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, products, or services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

We may update these Terms as the business, website, services, or legal requirements change.

The current version will be posted on this website with its effective or updated date. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
